Terms of Service — SWJ
OVERVIEW
Welcome to SWJ. The terms “we”, “us” and “our” refer to SWJ (brand) operated by Arissa Studio di Clarissa Dong (registered trade name). We operate this online store and website (the “Services”) on Shopify.
These Terms of Service (the “Terms”), together with our Privacy Policy and Refund & Return Policy, govern your use of the Services. By accessing or using the Services, you agree to these Terms and our policies. If you do not agree, please do not use the Services.
1. ACCESS AND ACCOUNT
You confirm you are of the age of majority in your place of residence and, if applicable, that you consent to allow your minor dependents to use the Services. You agree to provide accurate and complete information (e.g., email, billing, shipping) and to keep your account credentials secure. You are responsible for all activities under your account and may not transfer or assign it.
2. OUR PRODUCTS
We try to display products accurately; however, colors and appearance may vary depending on your device and settings. Descriptions, pricing and availability may change at any time. We may discontinue products or limit quantities per person or per region at our discretion.
3. ORDERS
Placing an order is an offer to purchase. We may accept or decline any order; acceptance occurs when we confirm and process payment. Please check your order carefully before submitting—cancellations may not be possible after acceptance. Purchases are for personal use only (no resale/export). Returns are governed by our Refund & Return Policy.
4. PRICES AND BILLING
Prices, promotions and discounts may change without notice. The price charged is the price in effect at checkout and in your confirmation email, exclusive of taxes, shipping and any customs/import charges unless otherwise stated. You agree to provide valid payment details and authorise us to charge all amounts due.
5. SHIPPING AND DELIVERY
Delivery times are estimates and not guaranteed. We are not responsible for delays outside our control (e.g., carrier delays, customs). Title and risk of loss pass to you upon our delivery to the carrier. See Shipping Policy for details.
6. INTELLECTUAL PROPERTY
All content in the Services (including trademarks, logos, text, graphics, images, videos, design and arrangement) is owned by SWJ / Arissa Studio di Clarissa Dong or its licensors and protected by applicable intellectual property laws. You may use the Services for personal, non-commercial purposes only. You may not copy, modify, distribute, display, perform, or create derivative works without our prior written consent. “Shopify” and related marks are trademarks of Shopify; other marks belong to their respective owners.
7. OPTIONAL TOOLS & NEW FEATURES
We may provide access to tools or features from third parties on an “as is” and “as available” basis without warranties. Your use of such tools is at your own risk and subject to the providers’ terms.
8. THIRD-PARTY LINKS
The Services may link to third-party sites or materials. We are not responsible for examining or evaluating their content and disclaim any liability for your use of them. Review third parties’ policies before engaging in any transaction.
9. RELATIONSHIP WITH SHOPIFY
Our store is powered by Shopify. Sales are made directly between you and SWJ / Arissa Studio di Clarissa Dong. Shopify is not a party to those sales and is not responsible for any related claims between you and us.
10. PRIVACY
Personal data is processed in accordance with our Privacy Policy and, where applicable, Shopify’s privacy terms. Because our Services are hosted by Shopify, certain personal data about your use of the Services will be processed by Shopify and its service providers (which may be located outside your country) to operate and improve the Services.
11. FEEDBACK & REVIEWS
By submitting reviews, suggestions or other content (“Feedback”), you grant us a worldwide, perpetual, sublicensable, royalty-free licence to use and display the Feedback for any purpose. You represent that you own or control the rights to your Feedback and that it does not infringe third-party rights or violate these Terms. We may moderate or remove Feedback at our discretion.
12. ERRORS, INACCURACIES & OMISSIONS
Information on the Services may contain errors or omissions (e.g., pricing, availability, shipping charges). We reserve the right to correct them and to cancel orders if any information is inaccurate, including after you submit an order.
13. PROHIBITED USES
You may not use the Services for unlawful purposes; to violate laws or third-party rights; to transmit malware, spam or deceptive content; to harass or harm others; to scrape or collect data without consent; to circumvent security; or to copy, resell or exploit the Services. We may suspend or terminate access if we believe these Terms are violated.
14. TERMINATION
We may suspend or terminate your access at any time. Sections that by nature should survive (e.g., Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law) will continue to apply.
15. DISCLAIMER OF WARRANTIES
Except as required by law or expressly stated by us, the Services and all products are provided “as is” and “as available”, without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose and non-infringement). Your use is at your own risk. Some jurisdictions do not allow certain disclaimers—mandatory consumer rights remain unaffected.
16. LIMITATION OF LIABILITY
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages (including lost profits, revenue, data or replacement costs) arising from your use of the Services or products, even if advised of the possibility. You agree to indemnify and hold harmless SWJ / Arissa Studio di Clarissa Dong, Shopify, and our respective affiliates, directors, employees and agents from claims and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Services.
18. SEVERABILITY
If any provision is found unlawful or unenforceable, it shall be enforced to the maximum extent permitted and the remainder will remain in effect.
19. WAIVER; ENTIRE AGREEMENT
Our failure to enforce any provision is not a waiver. These Terms, together with policies referenced here, constitute the entire agreement between you and us regarding the Services and supersede prior understandings.
20. ASSIGNMENT
You may not assign or transfer these Terms without our prior written consent. We may assign or transfer our rights and obligations without notice.
21. GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by the laws of Italy and applicable EU consumer protection law. Unless mandatory law provides otherwise, any disputes may be brought before the courts of Prato (PO), Italy, and consumers residing in the EU may also bring claims in the courts of their place of residence.
